Issues and Appeals

Battle & Winn lawyers are fully prepared to litigate every case through trial and appeal. We have significant experience in front of the Alabama Supreme Court, the Federal Courts of Appeals, and the Supreme Court of the United States. We believe that great appeals begin at the trial and pre-trial levels, and we prepare our cases with that in mind. Battle & Winn lawyers also can be retained post-verdict to litigate issues and appeals in state and federal appellate courts. We will identify issues on which you can succeed, brief your appeal, and argue your case before the appellate courts.

Estate Litigation

Sadly, when a family member dies, a family can be torn apart rather than brought together. Battle & Winn lawyers have represented families in disputes where substantial assets hang in the balance. We can litigate your will dispute, protect your interests, and maximize the assets of the estate. We have litigated will contests throughout Alabama, and all the way to the Alabama Supreme Court.

Litigation on Behalf of Individuals

We believe that individuals should have access to the civil justice system at the same high level as businesses. Battle & Winn represents our individual clients with the same creativity and intensity as we do our business clients. We regularly litigate non-compete and non-solicitation clause cases, shareholder direct and derivative cases, fraud cases, business dissolutions, and cases involving serious injury or wrongful death. 

Insurance Coverage Litigation

We represent policyholders when their insurance companies will not honor their agreements. Battle & Winn lawyers have experience litigating coverage disputes for business and individuals, including bad faith denials of legitimate claims. We work to ensure our clients receive the insurance coverage they paid for and deserve.

Robert E. Battle

Education

Bob received his B.A. in Political Science from Yale College in 1992, and his J.D. from Vanderbilt Law School in 1995.

Bar Admissions

Bob is admitted to practice in Alabama state and federal courts; the U.S. District Court for the District of Colorado; the U.S. District Court for the Central District of Illinois; the Northern District of Alabama Bankruptcy Court; and the Fifth and Eleventh Circuit Courts of Appeals. Bob also has been admitted pro hac vice in courts in Florida, Delaware, Oklahoma, Louisiana, Mississippi, and Pennsylvania.

Outside the Firm

Bob grew up in Huntsville, Alabama. He is married to Brooke Tanner Battle. Brooke and Bob have two daughters. When not spending time with his family, Bob serves as the president of the Yale Club of Alabama and as a member of the executive committee of the Birmingham Bar Association. He is the a past chair of the Federal Practice Section of the Birmingham Bar Association and past member of the Birmingham Bar Foundation board of directors. Bob is also a member of The Kiwanis Club of Birmingham. Bob has been honored with selections to the Project Corporate Leadership class of 1999, the Birmingham Business Journal "Top 40 Under 40" class of 2001, the Alabama State Bar Leadership Forum class of 2006, the Leadership Birmingham class of 2012, and the Leadership Alabama Class of 2018.

Biography

Battle & Winn lawyer Bob Battle is a founding partner in the firm. Before starting Battle & Winn, Bob was a partner at a law firm of more than 200 attorneys based in Birmingham. Prior to private practice, Bob served as a law clerk to the Honorable Ira DeMent, United States District Judge for the Middle District of Alabama.

Bob's practice has focused primarily on business and commercial litigation, including insurance coverage litigation, as well as, False Claims Act and whistleblower litigation. He also has significant experience in personal injury and wrongful death cases. Bob has tried complex litigation matters to successful verdicts. Bob also has substantial appellate experience, including obtaining favorable rulings from appellate courts to uphold verdicts he won at trial.



Since 2005, Bob has been AV-rated by Martindale-Hubbell, which is the highest possible rating available based on confidential reviews by peers, clients and the judiciary. Since 2010, Bob has been recognized as an Alabama “Super Lawyer" and was named by Super Lawyers as one of the Top 50 Attorneys in Alabama in 2017. Bob has also been recognized as a Mid-South "Super Lawyer" since 2016. B-Metro Magazine has recognized Bob as one of the top lawyers in Birmingham since 2010. Bob has been selected by his peers for inclusion in The Best Lawyers in America since 2016, including being named Lawyer of the Year in Birmingham for Insurance Litigation in 2019.

Harlan F. Winn III

Education

Harlan obtained his B.A. in economics from Washington & Lee University in 1990, and he received his J.D., summa cum laude, from the Cumberland School of Law at Samford University in 1994. In law school, Harlan was awarded the Dean's Scholarship, elected to the Honor Court, and served on the editorial board of the Cumberland Law Review.

Bar Admissions

Harlan is licensed to practice in the state and federal courts of Alabama and Mississippi, and the Fifth and Eleventh Circuit Courts of Appeals. He has appeared pro hac vice in courts in Florida, Georgia, Louisiana, Tennessee, California, Delaware, Pennsylvania, and Oklahoma.

Outside the Firm

Harlan grew up in Pensacola, Florida. He and his wife, Gina, have four children. Harlan is a retired youth baseball, basketball, softball, and soccer coach. He has served on the Board of Directors of the Birmingham Golf Association. Harlan teaches youth Sunday School at Canterbury United Methodist Church. When time permits, he is an avid outdoorsman.

Harlan represents these clients as plaintiffs and defendants in cases in federal and state courts nationwide. He has served both as class counsel and lead defense counsel in state and nationwide class actions. Harlan is rated AV by Martindale-Hubbell, which is the highest possible peer review rating. Harlan is recognized as an Alabama “Super Lawyer”—a recognition limited to only 5% of Alabama lawyers each year. Adam P. Plant

Adam earned his B.A. in Journalism and Mass Communication from Samford University in 1999 after attending Samford on a Presidential Scholarship. He earned his J.D. cum laude from The University of Alabama School of Law in 2003. While in law school, he served as Editor in Chief of the Alabama Law Review.

Adam is admitted to practice in Alabama and the District of Columbia. He also is admitted to practice in federal courts in Alabama and before the United States Court of Appeals for the Eleventh Circuit. He has been admitted pro hac vice in the Southern District of California, Northern District of California, Northern District of Georgia, Eastern District of Missouri, Southern District of Florida, District of New Mexico, United States Courts of Appeals for the 8th and 9th Circuits, and California state courts.

Outside the Firm

Adam grew up on a farm in Madison County, Alabama. He and his wife Abbey live in the Cahaba Heights community with their three children. He served as a member of the Cahaba Heights Master Plan Steering Committee for the City of Vestavia Hills, and is a member of the advisory board for the Samford University Department of Journalism and Mass Communication. Adam is a deacon at Shades Mountain Baptist Church, and he also works with a student department Sunday school class.

Biography

Battle & Winn lawyer Adam Plant joined the firm in 2011 after spending six years at a national litigation firm based in Birmingham. Before entering private practice, Adam served as a Deputy Solicitor General for the State of Alabama. During his time working at the Office of the Alabama Attorney General, Adam litigated on behalf of the people of Alabama in both state and federal appellate courts, including the Supreme Court of Alabama, the United States Court of Appeals for the Eleventh Circuit, and the Supreme Court of the United States, including at the cert stage, merits briefing, and briefs amicus curiae. Adam then served as a law clerk for the Honorable William H. Pryor Jr. on the United States Court of Appeals for the Eleventh Circuit.





Adam has represented clients in antitrust, securities, and shareholder derivative cases; class actions; and complex litigation. He has represented small businesses, shareholders, members of the United States Armed Forces, doctors and medical associations, cattle ranchers, and row crop farmers in state and federal courts nationwide, including extensive experience in multidistrict litigation. At Battle & Winn, Adam represents clients in matters including prosecuting and defending personal injury, fraud, financial services, and contract cases. He is rated AV by Martindale-Hubbell, which is the highest possible peer review rating. Adam was recognized as an Alabama “Super Lawyers Rising Star”—a recognition limited to only 2.5% of Alabama lawyers under 40 each year.
