Sadly, when a family member dies, a family can be torn apart rather than brought together. Battle & Winn lawyers have represented families in disputes where substantial assets hang in the balance. We can litigate your will dispute, protect your interests, and maximize the assets of the estate. We have litigated will contests throughout Alabama, and all the way to the Alabama Supreme Court.

Litigation on Behalf of Individuals

We represent policyholders when their insurance companies will not honor their agreements. Battle & Winn lawyers have experience litigating coverage disputes for business and individuals, including bad faith denials of legitimate claims.

Battle & Winn represents our individual clients with the same creativity and intensity as we do our business clients. We regularly litigate non-compete and non-solicitation clause cases, shareholder direct and derivative cases, fraud cases, business dissolutions, and cases involving serious injury or wrongful death.

Insurance Coverage Litigation

We represent policyholders when their insurance companies will not honor their agreements. Battle & Winn lawyers have experience litigating coverage disputes for business and individuals, including bad faith denials of legitimate claims. We Are

Innovative, Experienced

Litigation Lawyers

We have a proven track record of achieving results for our clients by creating and implementing smart litigation strategies that earn the respect of judges, juries, and our peers.

Areas of Practice

The “litigation process” is not an end unto itself—it’s how Battle & Winn lawyers prepare a persuasive argument for our clients that is convincing to a judge or jury. We bring efficiency, creativity, and intensity to large-scale litigation and single-event cases. We focus our resources on important issues that improve our clients’ results.

Business and Commercial Litigation

We are experienced lawyers who handle business litigation nationwide. We prepare to win every case at trial. But, we approach business cases with a business mindset. We create smart litigation strategies and recognize that not every dispute demands long, protracted litigation. We work with our clients to find a strategy that fits for you.

Complex Litigation and Class Actions

Battle & Winn lawyers prosecute and defend complex civil cases for diverse clients—from aggrieved individuals to businesses of all sizes—in both state and federal courts. Battle & Winn lawyers have served as lead counsel for plaintiffs and defendants, and proven that they have the skills, experience, and smarts to take cases to trial and win.

Issues and Appeals

Battle & Winn lawyers are fully prepared to litigate every case through trial and appeal. We have significant experience in front of the Alabama Supreme Court, the Federal Courts of Appeals, and the Supreme Court of the United States. We believe that great appeals begin at the trial and pre-trial levels, and we prepare our cases with that in mind. Battle & Winn lawyers also can be retained post-verdict to litigate issues and appeals in state and federal appellate courts. We will identify issues on which you can succeed, brief your appeal, and argue your case before the appellate courts.

Estate Litigation

Sadly, when a family member dies, a family can be torn apart rather than brought together. Battle & Winn lawyers have represented families in disputes where substantial assets hang in the balance. We can litigate your will dispute, protect your interests, and maximize the assets of the estate. We have litigated will contests throughout Alabama, and all the way to the Alabama Supreme Court.

Litigation on Behalf of Individuals

We believe that individuals should have access to the civil justice system at the same high level as businesses.

We work to ensure our clients receive the insurance coverage they paid for and deserve.

Our Team

Relied on by clients and co-counsel.

Respected by judges. Highly rated by our peers.
